Terms of Service

These Terms of Service ("Terms") govern your access to and use of TutorManager ("Service"), operated by ZinZ Blaž Smolnikar s.p., Miklavž pri Taboru 6, 3304 Tabor, Slovenia, tax ID 24614939 ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. The Service is primarily intended for businesses and professional tutors. If you are a private individual (consumer), applicable consumer protection law may grant you additional rights, including a 14-day right of withdrawal — however, since the Service includes a free 14-day trial, the right of withdrawal is effectively exercised during the trial period at no cost.
1. Description of Service
TutorManager is a cloud-based platform for tutoring schools and language centers that provides tools for managing students, teachers, lessons, courses, invoicing, and related administrative tasks. Each customer receives an isolated tenant environment accessible at a subdomain of tutor-manager.com.
2. Account Registration
To use the Service you must register an account with accurate business information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately at info@zinz.si of any unauthorized use.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable law
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Transmit malicious code, spam, or disruptive content
- Resell or sublicense access to the Service without our written consent
- Use the Service to store or transmit data that infringes third-party rights
- Use automated scripts or bots to access the Service in ways that place excessive load on infrastructure
4. Free Trial
New accounts receive a 14-day free trial with full access to the Service. No payment information is required during the trial. At the end of the trial period, your account enters a 7-day grace period during which the Service remains accessible but in-app notices are displayed. If no subscription is arranged within the grace period, access to your account will be suspended. Trial and grace-period data is retained for 30 days after suspension, after which it is permanently deleted. We reserve the right to modify the trial duration.
5. Subscription and Payment
After the trial, continued use of the Service requires a paid subscription. Pricing and available plans are communicated directly by us at info@zinz.si. Invoices are issued in advance for the agreed billing period (monthly or annually) and are payable within 14 days of the invoice date. Accepted payment methods include bank transfer and electronic payment services (e.g. PayPal, Stripe). All fees are non-refundable unless required by applicable law. Failure to pay within the payment period entitles us to suspend access until the outstanding amount is settled. We may adjust pricing with 30 days' written notice; continued use after the new pricing takes effect constitutes acceptance.
6. Cancellation
You may cancel your subscription at any time by notifying us in writing at info@zinz.si. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time. After cancellation your data is retained for 30 days, after which it is permanently deleted.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You retain ownership of all data you submit to the Service. You grant us a limited licence to store and process that data solely to provide the Service. Each customer's data is stored in an isolated database schema and is not shared with other customers.
8. Data Processing Agreement
Where you upload personal data of your students, clients, or other individuals, you act as the data controller and we act as a data processor under GDPR. We process such data solely on your documented instructions. By accepting these Terms you also accept our data processing obligations as described in our Privacy Policy.
9. Intellectual Property
The Service, including all software, designs, and documentation, is owned by us and protected by intellectual property law. You may not copy, modify, distribute, or create derivative works without our written permission. Customer data remains the property of the customer at all times.
10. Availability and Support
We strive to maintain high availability but do not guarantee uninterrupted access or a specific uptime SLA. Planned maintenance will be announced in advance where possible. Support is provided by email at info@zinz.si on a best-effort basis during business hours (CET/CEST).
11. Force Majeure
We are not liable for failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, power failures, internet outages, cyberattacks, or actions of third-party providers.
12. Termination
We may suspend or terminate your account immediately if you breach these Terms, fail to pay, or if continued provision of the Service becomes unlawful. You may request termination at any time. Upon termination for any reason, data is retained for 30 days and then permanently deleted.
13. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages (including loss of profits, data, or business) arising from your use of or inability to use the Service. Our total aggregate liability for any claim arising under these Terms is limited to the fees you paid in the 3 months immediately preceding the event giving rise to the claim.
14. Governing Law and Disputes
These Terms are governed exclusively by the laws of the Republic of Slovenia, without regard to conflict-of-law rules. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent court in Ljubljana, Slovenia.
15. Changes to Terms
We may update these Terms from time to time. We will notify registered customers by email or in-app notice at least 14 days before changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.

Pogoji storitve

Ti pogoji storitve ("Pogoji") urejajo vašo uporabo platforme TutorManager ("Storitev"), ki jo upravlja ZinZ Blaž Smolnikar s.p., Sp. Škofja vas 42, 3211 Škofja vas, Slovenija, davčna številka 24614939 ("mi", "naše"). Z ustvarjanjem računa ali uporabo Storitve se strinjate s temi Pogoji. Storitev je primarno namenjena podjetjem in profesionalnim inštruktorjem. Če ste zasebna oseba (potrošnik), vam veljavna potrošniška zakonodaja lahko podeljuje dodatne pravice, vključno s 14-dnevno pravico do odstopa — ker pa Storitev vključuje brezplačno 14-dnevno preskusno obdobje, se pravica do odstopa v praksi uveljavi med preskusnim obdobjem brez stroškov.
1. Opis storitve
TutorManager je oblačna platforma za inštruktorske šole in jezikovne centre, ki omogoča upravljanje učencev, učiteljev, ur, tečajev, računov in sorodnih administrativnih nalog. Vsak naročnik dobi izolirano okolje, dostopno na poddomeni tutor-manager.com.
2. Registracija računa
Za uporabo Storitve morate ustvariti račun z natančnimi poslovnimi podatki. Odgovorni ste za varovanje svojih poverilnic in vse dejavnosti pod vašim računom. O morebitni nepooblaščeni uporabi nas nemudoma obvestite na info@zinz.si.
3. Dovoljeno ravnanje
Strinjate se, da ne boste:
- Storitve uporabljali za nezakonite namene ali v nasprotju z veljavno zakonodajo
- Poskušali pridobiti nepooblaščen dostop do katere koli části Storitve ali njene infrastrukture
- Pošiljali zlonamerne kode, neželene pošte ali motečih vsebin
- Prodajali ali pod-licencirali dostop do Storitve brez naše pisne privolitve
- Shranjevali ali prenašali podatke, ki kršijo pravice tretjih oseb
- Z avtomatiziranimi skripti ali boti dostopali do Storitve na način, ki prekomerno obremenjuje infrastrukturo
4. Brezplačno preskusno obdobje
Novi računi prejmejo 14-dnevno brezplačno preskusno obdobje s polnim dostopom do Storitve. Podatki o plačilnem sredstvu niso potrebni. Po izteku preskusnega obdobja nastopi 7-dnevno prehodno obdobje, med katerim je Storitev še dostopna, v aplikaciji pa so prikazana opozorila. Če v prehodnem obdobju ne uredite naročnine, se dostop do vašega računa blokira. Podatki se hranijo 30 dni po blokadi, nato so trajno izbrisani. Trajanje preskusnega obdobja si pridržujemo pravico spremeniti.
5. Naročnina in plačilo
Po preskusnem obdobju je za nadaljnjo uporabo Storitve potrebna plačljiva naročnina. Cene in razpoložljive pakete sporočamo neposredno na info@zinz.si. Računi se izdajajo vnaprej za dogovorjeno obračunsko obdobje (mesečno ali letno) in so plačljivi v 14 dneh od datuma izdaje. Sprejeti načini plačila vključujejo bančno nakazilo in elektronske plačilne storitve (npr. PayPal, Stripe). Vsa plačila so nevračljiva, razen če to zahteva veljavna zakonodaja. Neplačilo v roku nas upravičuje do blokade dostopa do poravnave dolga. O spremembi cen vas obvestimo 30 dni vnaprej; nadaljnja uporaba po novem datumu veljavnosti pomeni sprejem novih cen.
6. Odpoved naročnine
Naročnino lahko kadar koli odpoveste s pisnim obvestilom na info@zinz.si. Odpoved začne veljati ob koncu tekočega obračunskega obdobja; sorazmerno vračilo za neporabljen čas ni mogoče. Po odpovedi se vaši podatki hranijo 30 dni, nato so trajno izbrisani.
7. Podatki in zasebnost
Uporaba Storitve je prav tako urejena z našo Politiko zasebnosti. Ohranite lastništvo vseh podatkov, ki jih posredujete Storitvi. Nam podeljujete omejeno licenco za shranjevanje in obdelavo teh podatkov izključno za namen zagotavljanja Storitve. Podatki vsake stranke so shranjeni v izoliranem podatkovnem okolju in niso deljeni z drugimi strankami.
8. Pogodba o obdelavi podatkov
Kadar v Storitev vnašate osebne podatke svojih učencev, strank ali drugih posameznikov, nastopate kot upravljavec, mi pa kot obdelovalec podatkov po Uredbi GDPR. Osebne podatke obdelujemo izključno po vaših dokumentiranih navodilih. S sprejemom teh Pogojev sprejemate tudi naše obveznosti glede obdelave podatkov, opisane v Politiki zasebnosti.
9. Intelektualna lastnina
Storitev, vključno z vso programsko opremo, oblikovanjem in dokumentacijo, je naša last in je zaščitena z zakonom o intelektualni lastnini. Brez našega pisnega dovoljenja je prepovedano kopiranje, spreminjanje, distribuiranje ali ustvarjanje izvedenih del. Podatki strank ostanejo last stranke.
10. Razpoložljivost in podpora
Prizadevamo si za visoko razpoložljivost, a ne zagotavljamo neprekinjene dostopnosti ali določenega SLA za čas delovanja. Načrtovana vzdrževalna dela bomo vnaprej napovedali, kjer je to mogoče. Podpora je na voljo po e-pošti na info@zinz.si v okviru možnosti med delovnim časom.
11. Višja sila
Nismo odgovorni za neizpolnitev ali zamudo pri izvajanju storitev, ki so posledica okoliščin zunaj naše razumne kontrole, vključno z naravnimi nesrečami, izpadi električne energije, prekinitvi interneta, kibernetskimi napadi ali ravnanjem tretjih ponudnikov.
12. Prekinitev
Vaš račun lahko takoj blokiramo ali prekinemo, če kršite te Pogoje, ne plačate ali če bi nadaljevanje zagotavljanja Storitve postalo nezakonito. Prekinitev lahko kadar koli zahtevate. Po prekinitvi iz katerega koli razloga se podatki hranijo 30 dni, nato so trajno izbrisani.
13. Omejitev odgovornosti
V največjem obsegu, ki ga dovoljuje zakon, nismo odgovorni za posredno, naključno, posebno ali posledično škodo (vključno z izgubo dobička, podatkov ali poslov), ki izhaja iz vaše uporabe Storitve ali nezmožnosti njene uporabe. Naša skupna odgovornost za vse zahtevke v okviru teh Pogojev je omejena na znesek, ki ste ga plačali v 3 mesecih neposredno pred dogodkom, ki je povzročil zahtevek.
14. Veljavno pravo in reševanje sporov
Te Pogoje ureja izključno pravo Republike Slovenije, brez upoštevanja kolizijskih pravil. Vsi spori, ki izhajajo iz teh Pogojev ali so z njimi povezani, so v izključni pristojnosti pristojnega sodišča v Ljubljani.
15. Spremembe pogojev
Pogoje lahko občasno posodobimo. Registrirane stranke bomo obvestili po e-pošti ali z obvestilom v aplikaciji vsaj 14 dni pred začetkom veljavnosti sprememb. Nadaljnja uporaba Storitve po tem datumu pomeni sprejem posodobljenih Pogojev.
